Acceptable Use Policy

Acceptable Use Policy

You will be held responsible for all actions performed by your account whether done by you or by others! If server security is compromised, the account holder is responsible for all violations of HPSOL’s Terms of Service (the “Terms of Service”) and this Acceptable Use Policy (this “AUP”), including SPAM, and all disconnect and reconnect fees associated with violations.

This Acceptable Use Policy specify the restrictions applied to the service you are subscribing from HPSOL. This policy is created and followed carefully to ensure the protection, integrity, reliability and privacy of HPSOL. as hosting provider. HPSOL. has the right to change this policy at any given time, and at the moment of its modification, its put into effect immediately. You alone are responsible for all actions that occur during your use of HPSOL’s services, and you agree not to use your services for causes that are prohibited.

Please note that this Acceptable Use Policy is subjected to change and it is Customer’s responsibility to regularly check for modifications. (Customers, users, and visitors are referred collectively as Customer).

Statement of Purpose
The Primary Purpose of HPSOL is to provide our clients with the resources necessary to put their Internet services online reliably in a lightning fast, high availability environment that responds quickly to each client’s individual needs.

Regarding Ultimate Liability
The client is ultimately responsible for individual server security. HPSOL disclaims all liability for server content.

Network Misuse
All clients are allowed access to the public and private network; however misuse of the network in any way, including interference, will result in a violation of this AUP. All violations of this AUP shall be subject to review by HPSOL, and an appropriate course of action shall be taken as determined by HPSOL in its sole discretion. Proper use of public network must comply with all local, state, and federal laws. Clients assume full liability for all content which they place on the server. Content displaying or transferring acts of copulation or exposed genitalia is prohibited, regardless of context. Forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting is deemed a violation of this AUP.

Sabotage
Any type of sabotage, regardless of intention, shall be grounds for termination of an account. This includes but is not limited to abuse of the remote reboot system by using it multiple times in a very short amount of time for improper reasons.

Monitoring Policy
HPSOL does not actively monitor the content on its servers. Dedicated server content will only be reviewed upon complaint. Content that does not violate local, state and federal law or this AUP or the Terms of Service is deemed in compliance and shall remain intact. If content is deemed to be in violation of this AUP or the Terms of Service, it shall be reviewed by HPSOL, and a course of action shall be taken to correct the problem, which may result in termination of the account or service.

Prohibited Content
The following is a list of content that is not accepted in our servers and network:
– Under Legal Age Nudity, Child Porn
– Scam/Fraudulent Websites
– Spam
– Mass mailing
– Reverse proxies
– Phishing websites
– Botnet controllers
– DDoS scripts
– Brute Force attacks
– Packet Flood scripts
– SIP Scanners
– IP Spoofing Attacks
– Virus / Trojan / Malware Distribution
– Terrorist Websites

Any other content not included in the previous list is considered as Allowed.

Content Considerations
The following is a list of restrictions that apply to the specified operations in our servers and network.
– TOR Services: TOR exit and relay nodes may only be run on our Dedicated Server Network with Dedicated Bandwidth.
– IRC Services: Legal use of IRC is allowed on our network. IRC may not be used on our network when the intentions are associated with the list of prohibited content.
– Bulk Email: Bulk Emailing is not allowed in shared hosting servers. VPS should not exceed 250 emails per hour or 5,000 emails per day. Dedicated Servers should not exceed 600 emails per hour or 10,000 emails per day. All email list used in bulk email should be opt-in. All Bulk Email campaign should include an automatic unsubscribe link.
– Video Streaming: Video streaming websites may only be run on our Dedicated Servers with Dedicated Bandwidth.
– Copyright related content and materials: Customer is responsible of all content hosted in our servers and network. DMCA is not a US regulation so immediate suspension or termination WILL NOT be executed upon the receiving of a DMCA complaint. Any website takedown notice that are not processed via US Authorities will be discarded. External linked content is not considered to be hosted in our servers or network and the complainer should contact the abuse team of the involved external provider.
– Freedom of speech: US Constitution respect freedom of speech. Consequently, we do not censor our members on the basis of content. The Customer is fully responsible of the content, posts, articles hosted in our servers or network. Complainer should forward copy of competent court order in order to request content removal, in the case that this is not possible the complainer will need to work directly with the Website operator to resolve the situation.
– Use of unlicensed software, While HPSOL. does not monitor what software a Customer is installing in our Servers. The Customer is fully responsible of getting appropriate software licensing. In the event of a complaint received from a software company we may request to remove or get valid license in order to continue operating in our network.

Blacklist Policy
If any client or any third-party user that is a customer of our client uses HPSOL services, network, or its physical infrastructure in a manner that causes HPSOL, or any IP addresses issued by HPSOL to be “blacklisted” or “blocked”, HPSOL reserves the right to suspend or terminate services of such client and/or suspend or terminate the access to services, network, and/or its physical infrastructure. Operating HPSOL service on behalf of, or in connection with or reselling any service to persons or firms listed in the Spamhaus Register of Known Spam Operations database at www.spamhaus.org shall constitute a violation of this AUP.

Law Enforcement
HPSOL may be required by law to submit client information to law enforcement officials, when presented with a valid subpoena from a court with proper jurisdiction. In such event, the information requested is disclosed as directed pursuant to the subpoena. The safety and privacy of any client will only be compromised by the court order of a subpoena. HPSOL will notify the client of the information request as allowed by the subpoena.

Violation Claims
Any Claim of Violation of this AUP that is being submitted by a third party must include the name and contact information of the complaining party, the IP address from which the alleged complaint originated, and a description of the violation. This AUP applies to all users of servers provided by HPSOL, including without limitation the customers, clients and other users of our clients.

HPSOL reserves the right, at its sole discretion, to refuse new service to any individual, group, or business. HPSOL also retains the right to discontinue service for any client for any reason or no reason and at any time, including without limitation for violation of this AUP.
